These Terms and Conditions govern the use of the WhiskyShop website and the purchase of products from McBeth on Whisky Pty Ltd through the website.

By using this website, creating an account, placing an order or purchasing products through the website, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms and Conditions, please do not use the website or place an order.

2. PRODUCTS AND SERVICES

WhiskyShop offers alcoholic beverages, including whisky, spirits and related products, for sale to customers in South Africa.

All products displayed on the website are subject to availability.

Product images are provided for illustrative purposes and, where applicable, packaging, labels, bottle design or presentation may differ from the images displayed on the website.

Product descriptions, sizes, alcohol percentages and other specifications are provided in good faith. Where an error is identified, WhiskyShop reserves the right to correct the information.

3. AGE RESTRICTION

You must be 18 years or older to purchase or receive alcoholic products from WhiskyShop.

By placing an order, you confirm that:

  1. You are at least 18 years of age;
  2. The information supplied by you is accurate and truthful; and
  3. You are legally permitted to purchase and receive liquor in South Africa.

WhiskyShop reserves the right to request valid identification to verify the age of a customer.

A delivery may only be handed to a person who is 18 years or older and who is able to provide acceptable proof of age when requested.

We will not knowingly sell, supply or deliver liquor to anyone under the age of 18.

If the recipient is unable to provide satisfactory proof of age, the delivery may be refused.

South African liquor legislation prohibits the sale or supply of liquor to persons under 18 years of age.

4. ORDERS

An order placed through the website constitutes an offer by the customer to purchase the selected products.

An order will only be considered accepted once:

  • payment has been successfully received;
  • the products are available; and
  • WhiskyShop has confirmed the order.

WhiskyShop reserves the right to decline or cancel an order where:

  • products are unavailable;
  • there has been an obvious pricing or product description error;
  • payment has not been successfully received;
  • the customer cannot satisfy the applicable age-verification requirements;
  • there is suspected fraudulent activity; or
  • delivery cannot reasonably be completed.

If WhiskyShop cancels an order because the product is unavailable or because WhiskyShop cannot fulfil the order, the customer will be entitled to a refund of amounts actually paid for the affected order, subject to applicable law.

5. PRODUCT PRICES

All prices displayed on the website are in South African Rand (ZAR).

Unless otherwise stated, prices include applicable VAT where required by law.

WhiskyShop reserves the right to change product prices at any time. A price change will not affect an order that has already been accepted and paid for, except where the order is affected by an obvious pricing or system error.

If an obvious pricing error occurs, WhiskyShop may contact the customer before fulfilling the order.

6. PAYMENT

Payment may be made using the payment methods made available on the website at checkout.

These may include supported credit and debit cards and other electronic payment methods made available through the payment gateway.

Where bank transfer/EFT payment is offered, payment instructions will be provided to the customer.

An order will not be dispatched until payment has been successfully received and verified.

7. CARD PAYMENT SECURITY

Online card payments are processed through Yoco, our payment service provider.

Card details entered during the payment process are processed through the applicable secure payment environment and are not stored by WhiskyShop as ordinary website customer information.

Yoco provides its own terms and privacy documentation relating to its payment services.

8. DELIVERY

Orders are generally processed within three business days after payment has been successfully received, subject to stock availability and any necessary verification.

Delivery generally takes approximately 8 to 14 business days, depending on the delivery destination, courier availability and other circumstances outside of WhiskyShop’s reasonable control.

The delivery period is an estimate and is not a guaranteed delivery date.

Customers will receive delivery or booking information where applicable once the order has been processed for dispatch.

We may deliver to residential and business/work addresses.

We may not deliver to P.O. Boxes or addresses where a secure handover cannot reasonably be completed.

The customer is responsible for ensuring that:

  • the delivery address is correct;
  • someone aged 18 or older is available to receive the order; and
  • the recipient can provide acceptable identification if requested.

9. AGE VERIFICATION ON DELIVERY

Because the products sold by WhiskyShop include alcoholic beverages, the courier or delivery agent may request identification from the recipient.

The delivery will not be completed to a person under 18 years of age.

If suitable identification cannot be provided, or if the courier reasonably believes that the recipient is under 18, the delivery may be refused.

Additional delivery charges may apply where a delivery must be attempted again because no eligible recipient was available or because the recipient failed the age-verification process.

10. DELIVERY CHARGES

A flat delivery charge of R150 applies to standard deliveries within the applicable delivery area.

Orders with a total value of R3,000 or more qualify for free standard delivery, unless otherwise stated on the website.

Certain locations, delivery services or special delivery requirements may be subject to different charges. Where additional charges apply, these will be communicated to the customer before the order is fulfilled.

11. DELIVERY DELAYS

WhiskyShop will make reasonable efforts to ensure that orders are dispatched and delivered within the estimated delivery period.

However, delays may occur because of circumstances outside WhiskyShop’s reasonable control, including courier delays, weather, public holidays, strikes, incorrect delivery information, unsuccessful delivery attempts, stock issues or other unforeseen circumstances.

WhiskyShop will communicate material delivery delays where reasonably possible.

12. RECEIVING YOUR ORDER

Customers should inspect their order as soon as reasonably possible after delivery.

If products arrive damaged, incorrect or materially different from the order placed, the customer should contact WhiskyShop as soon as possible and provide photographs and relevant order information where requested.

WhiskyShop will investigate the matter and, where appropriate, arrange a replacement, refund or other remedy in accordance with applicable consumer law.

13. RETURNS, CANCELLATIONS AND REFUNDS

WhiskyShop aims to provide customers with accurate products and reliable service.

Where a product is unavailable after an order has been accepted and paid for, WhiskyShop will notify the customer and, where applicable, provide a refund for the unavailable product.

Where a customer wishes to cancel an order, the customer should contact WhiskyShop as soon as possible.

Cancellation rights and refunds are subject to applicable South African consumer legislation.

Where a cancellation is permitted and the order has not yet been dispatched, WhiskyShop may process the cancellation without the customer having to return the product.

Where an order has already been dispatched or delivered, the applicable return and cancellation requirements will apply.

Nothing in these Terms and Conditions is intended to remove or restrict any mandatory consumer rights that cannot legally be excluded.

14. ELECTRONIC TRANSACTIONS AND COOLING-OFF RIGHTS

Where applicable, electronic transactions are subject to the Electronic Communications and Transactions Act 25 of 2002 (ECTA) and other applicable South African consumer legislation.

Certain electronic transactions may carry statutory cancellation or cooling-off rights, subject to the exceptions and requirements provided for by law.

The ECTA provides a seven-day cooling-off right for certain electronic transactions, subject to the Act.

Nothing in these Terms and Conditions limits any statutory right available to a customer.

15. DAMAGED OR INCORRECT PRODUCTS

If a customer receives a product that is damaged, defective or materially different from the product ordered, the customer should notify WhiskyShop promptly.

The customer may be asked to provide:

  • the order number;
  • photographs of the product and packaging;
  • details of the problem; and
  • any other reasonable information required to investigate the issue.

Where WhiskyShop is responsible for the issue, the applicable remedy will be provided in accordance with South African consumer law.

16. AVAILABILITY OF PRODUCTS

All products are subject to availability.

WhiskyShop may display products that subsequently become unavailable due to stock levels, supplier availability or other circumstances.

If a paid product becomes unavailable before dispatch, WhiskyShop will contact the customer and arrange an appropriate refund or alternative solution where applicable.

17. RESPONSIBILITY FOR ORDERS

WhiskyShop Woodstock (Pty) Ltd takes responsibility for the sale of products through this website, customer service, order processing, applicable dispute resolution and delivery arrangements.

Where third-party service providers are used, including payment providers and courier companies, their services may also be subject to their own terms and conditions.

18. CUSTOMER PRIVACY AND PERSONAL INFORMATION

WhiskyShop respects the privacy of its customers and takes reasonable steps to protect personal information.

The processing of personal information is governed primarily by the Protection of Personal Information Act 4 of 2013 (POPIA) and other applicable privacy legislation.

POPIA establishes requirements for the lawful processing and protection of personal information.

  • delivery and billing address;
  • telephone number;
  • email address;
  • order and transaction information;
  • account information; and
  • other information reasonably required to process and fulfil an order.

  • processing and fulfilling orders;

  • communicating with customers;
  • providing customer support;
  • preventing fraud and abuse;
  • maintaining website and customer accounts;
  • complying with legal obligations; and

WhiskyShop is not responsible for the content, privacy practices, availability or terms of third-party websites.

24. LIMITATION OF LIABILITY

WhiskyShop will take reasonable steps to provide accurate information and reliable services.

To the extent permitted by law, WhiskyShop will not be responsible for losses caused by circumstances outside its reasonable control, including third-party courier delays, network failures, payment-system failures, incorrect customer information or other events beyond WhiskyShop’s reasonable control.

Nothing in these Terms and Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable South African law.

25. FORCE MAJEURE

WhiskyShop will not be responsible for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include natural disasters, severe weather, strikes, civil unrest, government restrictions, infrastructure failures, telecommunications failures, courier disruptions, cyber incidents or other unforeseen events.

26. SOUTH AFRICAN LAW

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of the website or the purchase of products will be dealt with in accordance with applicable South African law.

Nothing in these Terms and Conditions prevents a consumer from exercising rights available to them under applicable consumer legislation.

27. CHANGES TO THESE TERMS

WhiskyShop may update these Terms and Conditions from time to time.

The latest version will be published on this website and will indicate the date on which it was last updated.

Changes will apply to future use of the website and future orders, subject to applicable law.
